Terms of use
How business subscribers may use Synthestat and what it produces.
Last updated: 5 October 2026
1. Scope and who may use the portal
Synthestat is operated by Briar Hamsfest Consulting s.r.o., identified on the company page. The portal is offered to business customers only, by subscription. We do not contract with consumers. Accounts are created by invitation for people who act for a subscribing organisation, and each user acts on behalf of that organisation.
Plans, prices, credits, service levels and usage rights are agreed in your organisation's subscription. Where the subscription agreement says something different from these terms, the agreement applies. Browsing the public pages does not create a subscription or grant a licence.
2. Accounts
Accounts are personal. Keep your sign-in details confidential and tell us at info@synthestat.com if you suspect unauthorised use. Your organisation's administrators manage who belongs to the organisation and with which role.
3. Acceptable use
Do not:
- compromise security, bypass access controls, overload the service or distribute malicious code;
- impersonate others, or upload or generate unlawful material;
- upload data you have no right to process, or more personal data than your work needs;
- try to identify real people from synthetic or aggregate outputs;
- copy or extract population datasets, models or software beyond what your subscription allows, or use our branding to imply endorsement.
We may restrict access or remove content that breaks these rules or the law. If we do, we tell the affected organisation and give our reasons, unless the law prevents it.
4. What the outputs are
- Synthetic outputs are AI-generated, model-based estimates. They are not responses from real people and are not measurements.
- Synthetic populations, profiles, answers, transcripts and narratives are modelled representations. They do not establish facts about an identifiable real person.
- Accuracy and uncertainty depend on the source data, population release, model, assumptions and intended use, and results can be biased where the source data or models are. The portal shows uncertainty with results; read it.
The AI transparency page explains which AI systems the portal uses and the limits of synthetic data.
5. How you may use outputs
- Within your subscription you may use outputs for your internal work and your work for clients.
- When you publish or pass on outputs, say that they are synthetic and AI-generated, and name Synthestat as the source.
- Do not present synthetic results as observed survey data, and do not use them to make decisions about identifiable individuals.
- If you publish AI-generated text to inform the public on matters of public interest, you are the deployer under Article 50(4) of the EU AI Act: label it as AI-generated, or have it reviewed under your own editorial responsibility.
- Use synthetic results to explore and prioritise. Check consequential decisions against real data. You remain responsible for the decisions you make with outputs.
- Academy videos are for training subscribers' users. Do not redistribute them. Their narration uses an AI-generated voice; Briar Hamsfest Consulting s.r.o. holds editorial responsibility for it.
6. Intellectual property and AI-generated material
Rights in the portal, its software, models, population datasets, documentation and branding belong to Briar Hamsfest Consulting s.r.o. or its licensors. They are licensed to your organisation for the subscription, not sold. Third-party materials keep their own licences; see credits and licences.
Under Czech copyright law an author is a natural person, so purely AI-generated material may not be protected by copyright. We do not claim exclusive copyright in it, and we do not guarantee that you will hold such rights. Parts a person created, such as your questionnaires and the selection and arrangement of a report, can be protected.
7. Your data
You are responsible for the content your organisation uploads: that you may use it, that personal data in it was lawfully collected, and that the people concerned received the information the law requires. Mark sensitive designs as restricted where the portal offers it.
The portal sends prompts built from your workspace content to AI model providers to produce outputs. The privacy notice lists them. Your organisation's administrators can switch on EU-only model routing.
Where we process personal data on your organisation's behalf, for example in uploaded human survey data, we act as its processor. Business customers conclude a data processing agreement with us under Article 28 GDPR for the personal data they upload, before they upload it. The standard agreement is available here; request a signed copy at info@synthestat.com.
8. Availability and changes
We aim to keep the portal available and its information current, but we do not guarantee uninterrupted availability or error-free content. Features, models and population releases change over time; each run records the model and release it used.
9. Responsibility
Each party remains responsible for its conduct under applicable law. Liability between you and us is governed by the subscription agreement and applicable law. Nothing in these terms excludes liability that cannot legally be excluded, including liability for intentional misconduct or gross negligence.
10. Applicable law and concerns
Czech law applies to these terms, subject to any mandatory rules that apply to you. Jurisdiction follows applicable law. Raise a concern with info@synthestat.com.
11. Updates and language
The date above identifies this version. Updates do not change an existing agreement retrospectively. These terms are provided in English and in Czech; if the two differ, the English version prevails.
